The power of mediation in debt resolution

Mr Bankruptcy

19th May 2022

If you’re looking for a way to resolve a debt issue without going to court, mediation is a positive alternative.

What is Meditation?

Mediation is a way to resolve debt disputes, in which participants negotiate their own settlement with the aid of a qualified third-party mediator.

How does mediation make a difference?

The structure and focus of mediation means it offers several advantages to help resolve disputes that other methods don’t.

Mediation is less restricted than a court process and can address the issues from the perspective of the individual parties rather than legal obligations and rights. This approach means mediation can offer participants a number of advantages:

  • It’s not bound by the legal rights and wrongs of a situation, so mediation can lead to creative solutions that suit all parties.
  • There’s more control of the outcome, through discussions during the mediation process.
  • The goal of the process is solely to create constructive negotiations that lead to an acceptable outcome.
  • It’s less formal than court proceedings, making participants feel less anxious, which can lead to more constructive conversations.
  • The mediator brings a wealth of experience in dispute resolution and facilitates constructive discussions by supporting better communication, to the advantage of all parties.
  • Finding an agreeable resolution, with all parties working towards the same object, means it can protect relationship between the two parties for the future.
  • The involvement of all parties in discussions encourages all participants to take responsibility for the outcome, so they are more likely to abide by it.

Entering into mediation is voluntary, so this already indicates a shared desire to find a resolution, which can then be capitalised on by creating an environment focused on achieving that shared goal.

Do you need mediation?

At James Rosa Associates we have mediated in debt disputes with successful outcomes. Parties that come to the mediation process who are prepared to participate with the intention of reaching an agreement, are willing to listen to all sides, are flexible, open to finding a creative solution and prepared to work with the mediator to find a solution that may involve compromise, will walk away with a resolution to their debt matters without the need for legal proceedings, with the extra cost and time involved.

Our mediation service offers a constructive process in which you remain directly involved in agreeing the outcome. It’s ability to preserve relationships for the future is important but even more important is its potential to help you manage the burden of debt and find a resolution that works.
